Article 1- Parties

Article 2- Subject

The purpose of this agreement is to specify the characteristics and sales price of the product ordered electronically by the Buyer from the Seller's website, www.karboardsports.com, and to carry out the sale, delivery of the product in accordance with the provisions of the Turkish Commercial Code, the Code of Obligations, Law No. 6502 on Consumer Protection, and the Regulation on Distance Contracts. The pre-information on the www.karboardsports.com website and the invoice issued upon the order placed by the BUYER are integral parts of this agreement.

If the delivery address of the product is outside of Turkey, additional shipping fees and customs-related expenses will be added separately.
The person/company to be invoiced must be the same as the contracting party. The provided information must be accurate and complete. If this information is incorrect or incomplete, the BUYER agrees to indemnify for any resulting damages and accepts all liability arising from such a situation. The SELLER reserves the right to suspend the order if it deems necessary due to discrepancies in the information provided by the BUYER. In case of problems identified with the order, if the SELLER cannot reach the BUYER, the SELLER suspends the order for a period of 15 (fifteen) days using the phone, email, and mailing addresses provided by the BUYER. The BUYER must contact the SELLER during this period. If no response is received from the BUYER within this period, the SELLER cancels the order to prevent both parties from incurring losses.

Article 4 – Contract Date and Force Majeure

Unforeseen or unavailable circumstances at the time of signing the contract, which are beyond the control of the parties and partially or completely prevent one or both parties from fulfilling their obligations or responsibilities under the contract in a timely manner, shall be considered force majeure (natural disasters, war, terrorism, riots, changes in legislation, seizure or strike, lockout, significant breakdowns in production and communication facilities, etc.). The party in the force majeure situation shall immediately notify the other party of the situation in writing. In the event of force majeure, neither party shall have any liability if they are unable to fulfill their obligations. If this force majeure situation continues for 30 (thirty) days, each party shall have the unilateral right to terminate the contract.
Article 5- Rights and Obligations of the Seller

5.1. The Seller undertakes to fulfill its obligations in full in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, except in cases of force majeure.

5.2. To make purchases on www.karboardsports.com, one must be at least 18 years old. The Buyer warrants that they are over 18 years of age by shopping on this website. The Seller cannot be held responsible for any transactions made by a user under the age of 18 who opens an account.

5.3. The Seller is not responsible for price inaccuracies resulting from system errors on www.karboardsports.com. The Seller is not responsible for promotional or pricing errors that may occur due to system errors, design, or illegal interventions on the website. The Buyer cannot claim any rights from the Seller based on system errors.

5.4. Visa, MasterCard, etc. credit cards or bank transfers can be used for purchases on www.karboardsports.com. Orders for which payment has not been made by bank transfer within 1 business day from the order date will be canceled. The time when orders are processed is not the moment the order is placed but rather the moment when the necessary collection is made from the credit card account or when the transfer (EFT) reaches the bank accounts. Payment methods such as cash on delivery or postal checks are not accepted without consultation with customer service.

5.5. For orders paid by bank transfer, there is a "payment notification form" that must be filled out after each order. The payment notification form is a form filled out by the buyer indicating the amount of the purchased products and the payment made, assisting the seller in processing transactions quickly and accurately. Karboard Sports Equipment Limited Company cannot be held responsible for any delays resulting from the buyer's failure to fill out or incorrectly fill out this form despite making payment to the seller's accounts.

5.6. The technical specifications of the products ordered by the Buyer are actually available in the manufacturer's technical documents. www.karboardsports.com is not responsible for errors and inaccuracies in the data provided by the manufacturer. The technical or visual information published on the www.karboardsports.com website is provided solely to assist customers, and the accuracy of the published data is entirely at the discretion of the Buyer. The Seller's pre-information does not constitute a guarantee.

5.7. Due to the nature of the web environment, there may be differences in color, size, and text between the product visually displayed and the product delivered. The primary criterion is the manufacturer's technical data regarding the product.

5.10. All technical data and images on www.karboardsports.com may not be used by users for any reason or commercial purpose.

5.11. Orders placed on www.karboardsports.com outside of business hours, on weekends, official holidays, or dates when the entire company or part of it is considered on administrative leave, will be processed on the first business day after their payments are transferred to the accounts.

5.12. The product stocks displayed on www.karboardsports.com may change as multiple orders for the same product can be placed by different individuals simultaneously. Therefore, the final product stock that can be obtained will be the products approved by the system during the ordering process, not the products added to the cart.

5.13. During purchases made on www.karboardsports.com, price fluctuations may occur due to changes in exchange rates. Therefore, the final pricing is determined by the prices shown in the order confirmation email.

5.15. Karboard Sports Equipment Limited Company reserves the right to cancel or modify any campaign or promotion offered to users through its websites without any prior announcement.

5.16. There may be multiple pricing options for a product on the website. This is related to the minimum package quantity of the item. A discount determined by the seller may be applied for purchases above the minimum package quantity.

5.17. It has been stated that www.karboardsports.com websites work best with the Google Chrome web browser. The Seller shall not be held responsible for any transaction or display errors arising from other web browsers.

5.18. If the product subject to the contract is to be delivered to another person or organization, the Seller shall not be held responsible if the recipient refuses to accept the product.

5.19. The minimum order limit for orders placed on www.karboardsports.com is set at $6 excluding VAT. Orders cannot be placed below this amount.

5.20. Shipping fees are charged for all orders below 1000 TL. This fee will be reflected in the amount to be paid and on the invoice, even if the order is picked up by the buyer from the seller's warehouse or branches, and will be collected from the buyer.

Article 6- Rights and Obligations of the Buyer
This article outlines the responsibilities and commitments of the Buyer.

6.1. The Buyer undertakes to fulfill their obligations in full, except in cases of force majeure.

6.2. By placing an order, the Buyer is deemed to have accepted the terms of this agreement and undertakes to make payment in accordance with the payment method specified in the contract.

6.3. The Buyer acknowledges that they are informed about the information provided about the seller on the website www.karboardsports.com, the basic qualities of the goods subject to sale, the sales price including taxes, the payment method, the delivery conditions and expenses, the right of withdrawal and how to exercise this right, the official authorities to whom complaints and objections can be addressed, etc., in a clear, understandable, and suitable manner for the internet environment. The Buyer acknowledges and declares that they have confirmed this preliminary information electronically.

6.4. In connection with the previous article, the Buyer declares that they have read and are informed about the order/payment/use procedure information provided on www.karboardsports.com, which includes product order and payment conditions, product usage instructions, precautions taken for possible situations, and warnings. The Buyer further declares that they have provided the necessary confirmation electronically.

6.5. In the event that the Buyer wishes to return the purchased product, they agree and undertake not to damage the product and its packaging, not to tear or damage the seal, not to use the product, not to replace it with another product, and to return the original invoice and delivery note at the time of return.

6.6. In the event that the product to be returned due to any defect is delivered to our company through the contracted cargo company, the product undergoes a technical examination. Depending on the suitability report provided as a result of this examination, if the return of the product is accepted, the Buyer will be contacted to either exchange it with another available product or receive a refund. These processes may take a total of 3 to 30 days.

Article 7 - Procedure Regarding Product Return and Right of Withdrawal
Under this article, the terms regarding the right of withdrawal and return of products purchased through www.karboardsports.com are explained under the following subheadings:

7.1. The right of withdrawal or return for products purchased through www.karboardsports.com is valid under the following conditions:

7.2. In accordance with the Consumer Protection Law numbered 6502, the buyer has the right to return the purchased products within 14 days without specifying any reason after receiving them from the shipping company. To exercise the right of withdrawal, the buyer can use the "Cancel and Return" option under the "My Orders" tab on the www.karboardsports.com website. The form opened for the return request must be completed in full. www.karboardsports.com internet sitesinde “Siparişlerim” sekmesi altında bulunan “İptal ve İade” seçeneğini kullanabilir. 7.3. İade işlemi için aşağıdaki koşulların sağlanması gerekmektedir:

• The "Return Form" in the "My Account" section must be completed in full.
• The return process must be completed within 14 days at the latest from the date the shipping company delivers the order to the buyer.
• The invoice of the product(s) to be returned must be filled out completely, including the return sections at the bottom, in accordance with the provisions of General Communiqué No. 385 of the Tax Procedure Law, and signed. If available, the delivery note should also be included with the return. (If the invoice of the product to be returned is a corporate invoice, the return process must be completed together with the return invoice issued by the institution. The return process of orders with corporate invoices cannot be completed without issuing a return invoice.)
• The products intended for return must be in their original packaging or the packaging prepared by Karboard Sports Equipment Limited Company without being opened or damaged. Additionally, the products' seals must not be torn or damaged.
• Returns of products prepared for special needs (custom design) are not possible.

Upon meeting the above conditions, the product(s) to be returned are examined by Karboard Sports Equipment Limited Company and, if necessary, by the manufacturers of the products, to determine whether they are suitable for return. The duration of this examination process typically ranges from 1 to 15 days. Once the return is approved, the refund of the product price is made using the payment method originally used by the buyer. Refunds to credit cards are processed by the Bank in accordance with the procedure outlined above.

7.5 The decrease in the value of the received goods or the impossibility of return does not prevent the exercise of the right of withdrawal. However, if the decrease in value or the impossibility of return is due to the fault of the consumer, the buyer is obliged to compensate for the value of the goods or the decrease in value. If the Seller considers that the return of the goods sent by the Buyer has become impossible, the Seller must notify the Buyer of this situation within 3 days at the latest from the date of receipt of the goods.

7.6 In commercial transactions outside the scope of the Consumer Protection Law No. 6502, the provisions of the Turkish Commercial Code apply regarding defects, hidden defects, or matters related to returns.

Article 8-Warranty
The warranty policies and practices of www.karboardsports.com are specified under the following conditions:

www.karboardsports.com will assist the buyer in initiating the warranty process determined by the manufacturer if it only has manufacturer warranties for the products it obtains from them.

When the buyer wishes to return a defective or faulty product, they must return it to the seller.

However, if it is understood that a counterfeit, imitation, or non-original product is being returned, the necessary procedures required by law will be followed. In this case, the responsibility lies entirely with the buyer.

For products sourced by www.karboardsports.com from suppliers other than the manufacturer, there is no specific and positive warranty policy. In this case, the warranty is entirely at the discretion of the seller.

The seller's warranty responsibility applies only to consumers covered under Law No. 6502. For commercial transactions, the provisions of the Turkish Commercial Code apply.

The above conditions explain the warranty practices and responsibilities of www.karboardsports.com. Therefore, buyers should consider these conditions regarding product returns or warranty claims.

Article 9 - Security

This information is only used securely to obtain authorization from the relevant banks during the collection process, and it is deleted from the system after the authorization process is completed. This practice is a measure aimed at ensuring the security of credit card information.
• Use of Contact Information: The buyer's contact information, such as email address, postal address, and phone number, is used only for standard product delivery and informational procedures. However, with the buyer's consent, promotional information, details about new products, or promotional offers may be sent.
• Security and Breach Situations: In cases where the security of the site or the terms of use are violated by the user in a manner that constitutes a crime, necessary information for the identification and prosecution of the relevant individual may be shared with law enforcement authorities.

This policy aims to protect the privacy of the buyer's personal information and ensure the security of personal information by taking appropriate security measures. Buyers should provide their personal information and accept the terms of use in consideration of this policy. .
Article 10 - Access to the Site, Protection of Account Information.

ARTICLE 11 – EVIDENCE AGREEMENT AND AUTHORIZED COURT<br All kinds of disputes arising from or related to this Agreement and/or its implementation shall be resolved based on the records of the SELLER (including records in magnetic media such as computer-audio recordings), which shall constitute conclusive evidence. The Parties agree that in disputes arising from the implementation and interpretation of this Agreement, within the monetary limits determined by the legislation, Consumer Arbitration Committees in the residence of the CUSTOMER and the SELLER shall have jurisdiction. In cases exceeding the jurisdiction of Consumer Arbitration Committees, the CUSTOMER and the SELLER accept that Consumer Courts shall be authorized.

ARTICLE 12 – EFFECTIVENESS
In the event of payment for an order placed through the website, the CUSTOMER shall be deemed to have accepted all the terms of this Agreement. The SELLER is obliged to make software arrangements to ensure that orders cannot be placed without obtaining confirmation that the Agreement has been read and accepted by the CUSTOMER on the website.
